Terms and Conditions: Introduction
These rules and conditions, which can be periodically adjusted, are applicable to all services, directly or indirectly (through distributors) provided online, by email, phone or any mobile device. Visiting, browsing or using our (mobile) site or any application on any platform (hereinafter referred to as the “Platform”) and / or making a reservation, you acknowledge that you have read, understood and agreed to the terms and conditions set forth below (including the confidentiality clause).
These pages, the content and infrastructure of these pages, as well as the online booking service (including the payment processing service) that we provide on these pages and through the site are owned and operated by Booking.com B.V. and are provided solely for your personal, non-commercial (B2C) use, subject to the following terms and conditions. The relationship between us and the Tourist Supplier is governed by separate terms describing the business (B2B), which we conduct with each Supplier of tourist services. Each Travel Service Provider acts professionally in relation to Booking.com, when it provides access to its product and / or service to / through Booking.com (both for other companies (B2B) and for end-users (B2C)). In addition to the rules and important information on the site, Travel Service Suppliers have the right to apply and / or require the fulfillment of their own additional conditions and rules relating to the use of the Tourist Product (including the limitation of liability provisions).
“Booking.com”, “us”, “us / us” or “our / our / our / ours” means Booking.com BV, a limited liability company that is subject to the laws of the Netherlands and is registered at: Herengracht 597, 1017 CE , Amsterdam, Netherlands. “Platform” means (mobile) site and application that are under the control, management and in the possession of Booking.com, on which the Tourist product is provided. “Tourist product” means various tourist products and services that can be ordered, purchased or rented from the Travel Service Provider.
“Travel Service Provider” means professional providers of accommodation services (eg hotel, apartment or bed and breakfast), leisure service providers (eg amusement parks, museums, excursions), transport service providers (for example, car rental, cruises, train tickets, airport transfers, bus tours), tour operators, travel insurance providers and all other travel service providers or products that are available for Booking for the Platform (B2B or B2C).
“Tourist service” means online purchase, order, payment (payment processing) or reservation offered by Booking.com in relation to the products and services of the Travel Service Supplier on the Platform.
“Booking” means the order, purchase, payment or reservation of the Tourist Product.
1. Description of the Tourist Service
Through the Platform, we (the company Booking.com BV and its affiliated partners (distribution partners)) provide an online platform through which the Travel Service Suppliers – in the context of their professional activities (B2B or B2C) – can advertise, promote in the market, sell and / or offer their products and services for ordering, buying, reserving or renting, and the respective users of the Platform can find such products or services, compare, order, purchase or pay them through the Tourist Serv Is. Using the Tourist Service (ie, making a Reservation through the Tourist Service), you enter into a direct (legally binding) contractual relationship with the Travel Service Provider from which you reserve or purchase a product or service. From the time you make a booking, we act solely as an intermediary between you and the Travel Service Provider, passing the relevant information of your booking to the appropriate Travel Service Providers and sending you an electronic confirmation on behalf of the Travel Service Provider. Booking.com does not (re) sell, rent or offer any (tourist) products or services.
When providing our Tourist Service, the information offered is based on information provided to us by Travel Service Providers. Travel service providers who promote and promote their Travel Products on the Platform have access to our systems and extranet and are fully responsible for updating information on prices, tariffs, fees, availability of numbers, rules, conditions and other data reflected on our Platform. Despite the fact that we do our best to ensure the quality of the Tourist Service, we can not verify the accuracy and ensure the accuracy or completeness of all information, and we are not responsible for any errors (including explicit and typographical), failures (arising from (temporary and / or partial) failure, repair, improvement or support of our Platform or for other reasons), inaccurate, inaccurate or false information or non-receipt of information. Each Travel Service Provider is responsible for the accuracy, completeness and correctness (descriptive) information (including tariffs, fees, prices, rules, conditions and availability of numbers) displayed on our Platform under any conditions. Our Platform is not and should not be considered as a recommendation or evidence of the quality, service level or rating (star rating) of any proposed Travel Service Provider (or its amenities, products, services, facilities or vehicles (basic or additional)).
Our Tourist Service is provided only for individual, non-commercial use. Therefore, you do not have the right to resell, create external hyperlinks, use, copy, track (for example, using “spider” and scrapping programs), display, download or reproduce any part of content or information, software, tickets, products or services available on our Platform, for any commercial or competitive activity or purpose.
2. Prices, strikethrough tariffs and the service “We return the difference in price”
The prices offered by Travel Service Providers on our Platform are very competitive. All prices for Tourist Products include VAT / sales tax and other taxes (which may vary) and fees, unless otherwise indicated on our Platform or in the electronic booking / ticket confirmation. Ticket prices are quoted for 1 person or group, the validity period is indicated on the ticket (if applicable). If the Tourist Supplier collects a cancellation or no-show cancellation fee, charges and taxes (including tourist / city tax) may also be added to it.
Sometimes our Platform is provided with lower tariffs for a certain period of stay, product or service, however such tariffs offered by the Tourist Supplier may have special restrictions and rules, for example, they can not be canceled or money can not be refunded. Please review the relevant conditions for booking, providing a product or service before making a booking.
The strike price for numbers is calculated based on the third highest price offered by the Tourist Supplier for your Tourist Product with identical booking or purchase conditions for the period equal to 30 days for which your arrival or use date falls (15 days before and 15 days after the date of arrival or use of the product, if between today and the date of arrival or use of the product is less than 15 days, we will add the appropriate number of days after the date of arrival or use of the product, umma it turned out 30 days).
